Welcome to Golden & Co. Travel, LLC, a WorldVia Travel Network Independent Agency. These Terms of Use ("Terms") govern your access to and use of Golden & Co. Travel' website(s) and services ("Site") when you interact with us as a consumer or client of our agency ("Service"). By accessing or using our Site, you agree to comply with and be bound by these Terms. If you do not agree, please refrain from using our Site.
1. Acceptance of Terms
By accessing or using our Site, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms or any of our other policies, do not use the Site. By agreeing to these Terms, you represent that you are at least the age of majority in your jurisdiction and have legal capacity to enter into agreements.

You are granted a limited, non-exclusive, non-transferable right to use the Site for personal purposes, including but not limited to, to assist you in interacting with travel advisors; viewing, commenting on, approving travel-related proposals and services; booking travel-related services; and accessing related information. Consumer use of the Site is for personal, non-commercial purposes only. You may not use the Site for any unlawful purpose or in violation of these Terms.
3.1. Eligibility
You must be at least 18 years old and capable of entering into legally binding contracts to use our Site. By using the Site, you represent that you meet this eligibility requirement.
3.2. Account Creation
If you create an account to use certain features on the Site, you are responsible for maintaining the confidentiality of your account credentials. You must provide accurate and up-to-date information, and you are responsible for all activities that occur under your account. You agree to notify Diane Ferreirar Travel Partners immediately of any unauthorized access or breach of security related to your account.
3.3. Prohibited Activities
When using the Site, you agree not to:
• Violate any applicable laws or regulations;
• Engage in unauthorized use of the Site or attempt to access areas restricted from public access;
• Transmit viruses, malware, or other harmful code;
• Use bots, scrapers, or other automated tools to access the Site without prior written permission;

• Impersonate others or misrepresent your identity.
4. Intellectual Property Rights

Travel, WorldVia or its licensors and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable right to access and use the Content for personal, non-commercial purposes. • Copy, modify, or distribute any part of the Site without prior written consent;
• Reverse-engineer, decompile, or attempt to extract the source code of the software used on the Site;
• Use the Site for commercial purposes or for the benefit of third parties without permission.
5. Transfer of Consumer Content
You understand that any content you input into the Site, including personal information (such as name, email, travel preferences, and other personally identifiable information), may be transferred across various networks, and adjusted or conformed to meet technical requirements. While we take reasonable measures to protect your personal data, transmissions over the internet are never completely secure. By using the Site, you acknowledge and accept this risk.
Credit card information, however, is always encrypted during transfer over networks, and is handled securely by our third-party payment processors.
6. Booking Travel Services
By booking travel services through the Site directly, through a web application that indirectly facilitates a transaction(s), or through an independent travel advisor who utilizes the Site, you acknowledge and agree that the travel advisor and/or travel supplier is solely responsible for providing the services. Golden & Co. Travel is not responsible for the fulfillment of services, payment disputes, or booking errors.
6.1. Third-Party Suppliers
Any travel bookings or services facilitated through the Site are provided by independent travel advisors and/or third-party suppliers. Golden & Co. Travel acts solely as an intermediary and assumes no liability for the performance, errors, or omissions of these independent travel advisors or travel suppliers. Any disputes must be resolved directly with the independent travel advisor or travel supplier.
6.2. Payment Processing
When making payments on the Site, you may be required to enter your payment card details and authorize Golden & Co. Travel or its partners to process transactions. By entering such details, you agree to:
• Authorize the processing of your payment by your designated travel advisor for travel-related services;
• Resolve any disputes directly with the relevant parties, including travel suppliers or your travel advisor;
• Handle payment information securely and comply with applicable data protection regulations.
• Golden & Co. Travel uses third-party payment processors that comply with PCI-DSS standards to ensure the security of your payment information.
All payments for services are processed by third-party payment processors that comply with industry-standard security protocols. We do not store credit card information on our servers. Credit card information provided during transactions is securely handled and retained in accordance with our Data Retention Policy. Any disputes regarding charges must be resolved directly with your travel advisor, the travel supplier, or your payment card provider.
7. Privacy and Data Protection
We take your privacy seriously. Please refer to our Privacy Policy for detailed information on how we collect, use, and protect your personal data. By using the Site, you agree to Diane Ferreira Travel Partner's Privacy Policy regarding the collection and use of your personal data.
8. Data Security
We implement reasonable security measures to protect your personal data. However, no method of transmission over the internet is completely secure. Golden & Co. Travel cannot guarantee the absolute security of your data and disclaims liability for any unauthorized access or breaches.
9. Travel Risk Disclaimer
Travel to certain destinations may involve greater risk than others. By offering for sale travel to specific international destinations, Golden & Co. Travel does not represent or warrant that travel to those locations is safe or without risk. You acknowledge and agree that you are responsible for reviewing government-issued travel advisories, warnings, and restrictions related to your chosen destination, which can be found through agencies such as:
• U.S. Department of State
• Transportation Security Administration (TSA)
• Centers for Disease Control and Prevention (CDC)
We encourage you to check these sources prior to booking travel. Golden & Co. Travel is not liable for any personal injuries, property damage, or other losses that may arise from travel to your selected destination.
10. Geographic Limitations
Our services are intended solely for persons residing within the United States. We do not knowingly market, sell, or provide services to individuals located outside of the U.S. By using the Site, you confirm that you are located within the United States and acknowledge that we reserve the right to refuse service to individuals or entities located outside of U.S. jurisdictions.
11. Pricing and Availability
Prices and availability of travel services are subject to change without notice. Any pricing errors will be corrected when discovered. If you have made a travel booking through Golden & Co. Travel. Golden & Co. Travel makes no claim, provides no warranty, and accepts no liability for the accuracy of pricing, availability or any suitability for any travel product offered, sold, or purchased.
12. Refund and Cancellation Policies
Refunds, cancellations, and changes to bookings are governed by the policies of Golden & Co. Travel and travel supplier providing the services. Please consult the specific policies provided at the time of booking.
13. Disclaimer of Warranties
The Site and its Content are provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, express or implied, regarding the Site's availability, accuracy, or reliability. Specifically, we disclaim any warranties of merchantability, fitness for a particular purpose, and non-infringement. You use the Site at your own risk.
14. Limitation of Liability
To the fullest extent permitted by law, Golden & Co. Travel, its affiliates, directors, officers, employees, or agents will not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of your use of the Site or services. This includes damages for loss of profits, data, or other intangible losses, even if we have been advised of the possibility of such damages.
15. Indemnification
You agree to indemnify, defend, and hold Golden & Co. We reserve the right to suspend or terminate your access to the Site at our sole discretion, without notice, for conduct that violates these Terms or is otherwise harmful to the interests of Golden & Co. Travel or others. Upon termination, you must immediately cease all use of the Site.
18. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Washington County in the state of Maryland.
19. Severability
If any provision of these Terms is found to be unlawful or unenforceable, it will be deemed severable from the other provisions and will not affect the validity and enforceability of the remaining provisions.
20. Entire Agreement
These Terms, together with our Privacy Policy and any other legal notices posted on the Site, constitute the entire agreement between you and Golden & Co. Travel regarding the use of the Site. Any prior agreements or understandings are superseded by these Terms.
21. Miscellaneous
These Terms operate to the fullest extent permissible by law. If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be deemed severable from these Terms and will not affect the validity and enforceability of any remaining provisions. The failure of Golden & Co. Travel to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by Golden & Co. Travel.
